Consider this: If you were Constantin, and you controlled the rights, would you rather take a percentage of Fox's box office or Marvel's? If Constantin really controlled the rights, they would have made a deal with Marvel long ago.
The Constantin logo still appears in front of every FF movie in Germany and Austria. The Constantin logo still appears on the covers of every FF BR and DVD in Germany and Austria. Including Fant4stic. So I guess, whatever the legal status is, Constant at least holds some rights to the propertyConsider this: If you were Constantin, and you controlled the rights, would you rather take a percentage of Fox's box office or Marvel's? I don't see that working. the Illuminati work in their setup, because they are seen as leaders of their specific communities. Black Bolt, King of the Inhumans; Namor, King of the Atlanteans; Strange, Sorcerer Supreme; Stark, Founder of the Avengers; Richards, seen as smartest man on Earth and leader of the scientific community (basically the Scientist Supreme if that wasn't the title the AIM head honcho normally uses); T'Challa (not a real member btw), King of Wakanda; Xavier, leader of the Mutants...maybe include Pym instead of Xavier

Pym in that equation might fulfill Richards' role in an MCU where the FF don't exist, but certainly not Xavier's
Just trade FoX some % of control of X-MEN toy, animation and video game rights and I say fair deal
whatever the deal between Fox and Constantin is, all three Fantsatic Four films are still marketed as Constantin movies in (at least) German speaking countries. The Fox logo doesn't appear anywhere on coversI'm sure that was part of the agreement, but like I say, I've seen from a number of sources that it's entirely in Fox's hands now.
Here's one mention, but not the most specific I've seen:

"I went to lunch with Bernd, who told me he'd sold both the film and the rights to Fox, who was going to make a $60 million version and they didn't want this low-budget movie around," recalls Corman. "I was kind of disappointed because it would have been an interesting challenge to distribute, but I was sitting there with a pretty hefty check."
as replacement for Mr. Fantastic, sure, he wouldI obviously meant take his place in the group not be a replacement for Mutants. He's one if the smartest men in the MCU he belongs in the illuminati
Toys, T-Shirts etc. are huge - not just because of the money they bring in directly but because kids playing with the toys, wearing the T-shirts etc. are advertising for the film. If Marvel and Fox can come to an agreement, it would put a lot more money in both of their pockets.
I would certainly be trying to make something like this happen if I were either Fox or Marvel.

The only reason to not do it would be to put more pressure on Fox to eventually give up on X-Men . . . but that seems unlikely, and I expect that if Marvel could get FF, they'd be happy to allow Fox to continue to focus on X-Men films.
The real money maker is merchandise. Marvel would be stupid to give any of that up. Then again, the Spidey deal seems to be stupid as hell, so who knows?
You would think Disney would've worked out a deal for the Hulk rights at this point.

I was referring to Marvel making money off Hulk. What makes you think Universal is making money off Hulk being in those movies?

I don't know if Universal's getting a cut of that or not. They're clearly eating Disney's lunch when it comes to Amusement parks on the East Coast though.
