After this whole reboot/reset/timeline change I'd love to see Archangel and maybe an Apocalypse story with some Dark Angel Saga elements mixed in.

lol... we're not ignoring you. I think Eleanor is fine, either for a young Jean Grey, Polaris or Scarlet Witch. All three characters have a similar look. Eleanor's current hair colour suggests Jean Grey, of course, but she could easily be another hair colour for a film.
Marvel Studios could use Scarlet Witch and Quicksilver in an Avengers film, but would be unable to mention the word 'mutant' or that they are the kids of Magneto. Fox can also use those two characters but can't mention the Avengers. That's the only case mentioned where both have rights.

I'm not sure how you can copyright the term 'Mutant', its a general descriptive word in the end. Even that 'Mutant X' show was allowed to go ahead and they freely used the term (the lawsuit mandated they had to make some changes to distance it more from X-Men, which is was obviously copying, but it still went ahead).
Maybe Fox's deal has it stipulated they have exclusive rights to the term with usage to Marvel Characters (that may well have been a result of the settlement over Mutant X?).
I can't see how Fox can just own the term 'Mutant' without that though.

Well, he auditioned for X3, Poseidon or not. He was probably only able to do Poseidon because they cast Ben.
