JGL is basically an A-list actor if his name is known in the academy. Not to mention, he's been in summer blockbusters before.

He may or may not be a villain, but I am certain that Nolan has something up his sleeves for JGL. A minor role as a rookie or 'beat' cop is a little weak. Be realistic.

If Nolan were to pull the old "switcheroo" on us again, it would seem far more likely that Talia would be the option, just given the small amount of information we have now. Alberto being the reveal would just seem very clunky and odd.

Moral justice trumps written law in cases such as Batman so this is incorrect.

That's your opinion, not fact.

I can understand people not seeing JGL's character as being a good guy, but that's mainly because we know we're supposed to root for Batman, who yes, is also a good guy, although he's basically a vigilante.
