The city is locked down and he's out of the city locked in a prison pit god knows where, it's not stupid to inquire exactly how did he get back into Gotham. "He's Batman" isn't enough of an explaination for a version of the story that goes out of it's way to take all (most) of the fantasy out of the character and his world. Nolan can't have his cake and eat it to.
Even in a more fantasy based Batman I'd still be annoyed by the complete lack of an explaination but I acknowledge that I might be able to let it go easier if the film wasn't striving to be gritty and semi-realistic.
I'm not saying that the explanation has to be "he's Batman." However, BB showed us that Bruce was trained to be an elite infiltrator, and knows how to get to places without being detected. The key thing is that he did it without his money, or his resources, so the precedent is definitely there. That being said, Is it really so hard to believe this same guy could not do the same thing we had already seen him do before? In fact the city being locked down doesn't stop you from knowing how to infiltrate, so long as you know what you're doing. For comparison's sake, look at how the reconnaissance team was able to make it to Gotham in spite of the lockdown. They hid behind a delivery truck disguised as workers. It's certainly not impossible to assume that Bruce hid in a truck or vehicle set to go to Gotham.
That being said, it doesn't mean that it's impossible to make it through. In fact, the only thing Bane locked down were the bridges (accessible only when Bane's minions confirmed) and had his team of Tumblers searching around Gotham for any intruders.
